You can, but it may not hold up where negligence is alleged.
Injury waivers have an important role to play in cycling events – its important to demonstrate that the participant has had opportunity to consider the inherent participation risks – its inevitable that accidents will happen and injuries will be suffered.
However, just because your event attendees have signed a waiver, does not mean that they could not bring legal action against you. Waivers are not enforceable where there is an allegation injury or death caused by an event organiser’s negligence.
Put yourself in the shoes of the riders. When signing these kinds of waivers they will always be assessing the risk on the presumption that the organisers will be exercising care, and managing the event with the competency reasonably expected.
Life-changing injuries can result in eye-watering losses.
In an increasingly litigious society there will always be a risk to event organisers should your negligent actions or inaction be alleged to have caused injury or loss. The expectation on controls the organisers have in place ramp up as event hazards multiply.
The cause of any such injury may appear innocuous but the effects can be life-changing and expenses can pile up rapidly. The injured party may require specialist and costly care for the remainder of their life, or their injuries may mean they need to call time on a prestigious career, foregoing substantial future earnings.
From small incidents significant claims do occur, no event big or small, and no event organiser is immune from the potential fallout. This is the key reason why we’ll recommend you opt for the highest liability limit you can reasonably afford. £5m and £10m limits are increasingly becoming the norm even for small businesses.

A key part of the risk assessment for overseas events will likely determine a need to ensure all participants have appropriate travel insurance, including cover for medical expenses and repatriation in case of serious injury. The event organiser would be expected to ensure all participants have arranged suitable cover.
There is no legal requirement for cyclists to have third party liability cover in the UK, however you should take care to ensure you understand the legal requirements of any other territories/municipalities that you may pass through. If it is legally required, the event organiser would be expected to ensure all participants have arranged suitable cover.

Even if it is not a legal requirement, participants should be reminded that they remain liable for their own actions while participating in the event and should consider third party liability cover. Personal Accident and Bike Damage/Theft insurance may also be encouraged.
